EASTHAM BOARD OF HEALTH
THURSDAY, JANUARY 29, 2009

Dr. Taylor, Co - Chairman opened the meeting at 3: p.m.
OPENING STATEMENTS:
Jane gave the monthly update concerning meetings etc.
Stearns & Wheler issued the final 2 volume Interim Needs Assessment and Screening Analysis Report of the Wastewater Management and Disposal Plan
project.
Final Report for Eastham Freshwater Ponds: Water Quality Status and Recommendations for Future Activities has been completed. The report was prepared by Coastal Systems Group -School of Marine Science &Technology University of Massachusetts Dartmouth and Cape Cod Commission Water Resources Program..
There may be a fee charge to use the Barnstable Carmody Data Base this year.
VARIANCES:
Richard Carlson 60 Rogers Lane Map-21 Parcel-69
Chris Wickson (East Cape Engineering) presented plans to upgrade the septic system. The variances requested include:
Reduction Requested under Title5 Regulations:
(Section 15.405 : contents of Local Upgrade Approval)
b) 2..0'+-/ to the 3.0' maximum cover allowed over portion of soil absorption system
(5.0'+/- maximum cover proposed)
Reduction Requested to Town of Eastham Board of Health Regulations:
1. 12'+/ - to the50' required setback for proposed septic tank to top of coastal bank.
(38'+/- setback proposed)
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. No increase in flow allowed
2. Deed restriction to 3 bedrooms
3. Well to be tested for VOC and Routine parameters
4. No increase in habitable area without board of Health review and notification to abutters
5. Over dig to be verified by Town of Eastham prior to installation of leach area.
6. Subject to Conservation Commission approval
Pat Lariviere made the motion to approve the plan with the 6 conditions.
Beverly Knox seconded the motion.

Roslyn Laporte 70 McGuerty Road Map-7 Parcel-437
Jason Ellis (Ellis Design) presented the plan to upgrade the septic system.
Mr. Stephen Sheptyck an abutter was presented. He had concerns that the new well location would effect his system. The Board and Mr.Ellis assure d him that the new well would not interfere with his property and would be require to test for VOC and Routine parameters.
The variances requested include:
Proposed S.A.S. is located less than 10' from the lot line (Pcl. 438 and McGuerty Road) -
(10' required 5' provided, 5' variance requested)
No reserve area provided - 310 CMR 15.248
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
No increase in flow
Deed restriction to 3 bedrooms
Well to be tested for VOC and Routine parameters
No increase in habitable with out BOH review and notification to abutters

Stephanie Sequin (Ryder/Wilcox Engineering) submitted a plan for installation of a new well. The variances requested include:
Town Eastham Board of Health Regulations
Section II, Drinking Water, E.Well Location1:
1. The proposed well shall be 9 feet from the edge of road layout where 25 feet is required.
2. The proposed well shall be 7 feet from a property line where 10 feet is required.
Sixteen and three foot variances were approved respectively.
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
Proposed well to be tested for VOC and Routine parameters
Well to street variance form to be recorded on the deed
Approval by the Conservation Commission as applicable
Dr. James Taylor made the motion to approve the plan with the 3 conditions.

APPEAL:
Robert Salva 20 Beach Road Map -19 Parcel - 28A
(Request continuance until February 26, 2009 meeting)
The Board UNANIMOUSLY VOTED to continue this appeal to the February meeting. Beverly Knox wanted to remind Mr. Salva that he or someone representing him be present at the meeting.
David Rost 130 Glacier Hills Road Map-9 Parcel-199
Attorney, Ben Zehnder and Jason Ellis (J.C.Ellis Design) representing the applicant has requested a building permit for an addition to expand the kitchen and living room. The property file contains no engineering Title 5 plan. The applicant is willing to provide exploratory digging and testing including sketch of system in place of the missing plan.
Dr.James Taylor made the motion that an engineering plan be submitted before construction continues.
Beverly seconded the motion.

Pat Lariviere made the motion to reduce testing to two times a year in the months of May & September.

REVIEW:

George Reilly (Land Design Associates) and Chris Childs (Patriot Builders)
on behalf of new owner requested review of modified floor plan. The septic plan would remain the same with Advantex AX 20 secondary alternative Technology. The revised floor plan was approved with the following conditions:
Routine water quality test results be provided of existing well location to assure potability
2. No increase in design be allowed
3. Secondary treatment and monitoring under general use conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, nitrate (or 2 times per year for seasonal use) After 2 year period of time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen not to exceed19 mg/l .
4. Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system. Operator to report results via Charmed Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
5. Deed restriction for 3 bedroom use and use alternative Advantex AX 20 System Alternative Technology requirement to be recorded on the deed.
6. Designer to verify proper operation of the system prior to issuance of Certificate of Compliance
7. Subject to Conservation Commission approval.

Jason Ellis (J.C. Ellis Design) submitted revised floor plans for over the garage.
the height of the room not to exceed 6' 11 ". The room over the
garage not to be used as a bedroom. The septic system had been previously approved 9/18/2008.
The variances requested and approved to upgrade the septic system include:
1. Proposed s.a.s. is located less than 10' from the lot line (PCL.54) -310cMR 15.211
(10' required -5' provided -5' variance requested)
2. No reserve area provided -310 CAR 15.248
3. Proposed s.a.s. is 51' from the top of a Coastal bank - Eastham Board of Health
Regulation (100' required -51' provided - 49' variance requested)
Finding that the applicant has submitted plans with secondary treatment the Board of Health approved the plan with the following conditions:
1. Routine water quality test results be provided of exiting well location to assure potability
2. No increase in design flow be allowed
3. Secondary treatment and monitoring under general use approval conditions per DEPregulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use). After this time reduction of testing could be requested to BOH by owner. nitrate-nitrogen not to exceed 19m9/1.
4. Operation and maintenance agreement to be submitted to EBOH. Operation and
maintenance agreement required for life of the system. Operator to report results viaCarmody Data Base provided through Barnstable County Health or directly to the Eastham Health Department if not available.

CORRESPONDENCE/ OTHER BUSINESS:
The Board decided to have a workshop Monday, March 2, 2009 at 10:am.
in the small meeting room in the Town Hall. This work shop will review different rules and procedures. Dr. Taylor stated that having a work shop would be beneficial every month or 2 months to review decisions made etc
Jane informed the Board that an applicant has requested to operate a body art establishment in the Town. The Board were given the forms for a permit to operate as a body practitioner and the form the applicant must submit to operate as a body establishment.
